We originate claims to purchase and factor for speciality pools of capital. Such situations are either non-recourse or partial recourse – the capital providers are either only compensated if the client’s case is successful or they pre-fund client’s a portion of the client’s claim and take a priority fee in the waterfall of cashflows from any recoveries.

To manage these risks we build customized technology platforms that enable us to efficiently underwrite, onboard and process thousands of claims. These case management systems give us transparency on all purchased assets with embedded controls to help the underwriting process, manage the litigation and monitor collections.

Our current focus is on property damage insurance claims in the US, government grant-backed programs in both the USA and EU, motor damage insurance claims in the EU and consumer claims against financial institutions also in Europe.

We purchase property damage claims and recover amounts for the seller.

In catastrophe situations such as windstorms in the USA, insurance carriers are unwillingly or extremely slow to pay claims despite the facts of the claim. Under the legal landscape in some states the policyholder can assign the benefits of the policy to the contractor and the contractor is left to recover the jobs costs from the insurer. Considerable strain is placed on the working cash flow of the constructor as the insurer often prevaricates and delays settling the claim.

We purchase the claims from the contractor under a structured purchase agreement at a discounted price, recover from the insurer, take a fee and return the balance to the constructor. We use technology to manage the recovery of thousands of these receivables.

We provide bridge financing for government backed grants.

In both the US and EU we are building programs to provide bridge financing for recipients of government grants or contracts. Whilst the funding is secure often the payment of the funds is slow and contractors who face liquidity issues, need the funds to complete the projects.

We assist consumers to fight for their rights.

Selling a claim to a third party can be useful when a business or an individual has a legal claim against an entity that has wrongly injured them, but the business or individual either cannot or does not want to pay the high fees and costs or take on the risk of litigation. We seek out such situations and work to fund them on a selective basis considering the merits of the case and the ability of the defendant to pay.

We purchase the right to such claims from plaintiffs for cash upfront and litigate against the defendant retaining the proceeds from the lawsuit for our investor if the litigation is successful.

In Poland, we have built three such products for consumers.

We offer a product to buy claims from consumers who were mis-sold Swiss franc mortgages as the mortgage contract proved to contain abusive clauses, we purchase car damage claims where the insurer has short changed the policyholder for their motor damage claim and we purchase “free credit” claims from consumers where the lender has abused key components of the consumer credit directive specifically enacted to protect the consumer.

We propose to develop further products in Europe.

Again we have used technology to build a bespoke case management system to enable us to effectively handle and litigate thousands of claims.
